No right of withdrawal for freshly prepared food
For contracts on the delivery of food and drinks that we prepare fresh after your order or adapt to your wishes (size, extras, notes), there is no right of withdrawal pursuant to § 312g (2) no. 1 of the German Civil Code (BGB). The same applies under § 312g (2) no. 2 BGB to goods that can spoil quickly or whose expiry date would soon be exceeded – which is the case for our prepared food.
This means: once we have confirmed your order, it can no longer be withdrawn. You are obliged to accept and pay for the food ordered.
What applies instead
Changing or cancelling an order: as long as we have not yet started preparing it, we will try to accommodate changes or cancellations. Please call us immediately: 07033 81390. There is no entitlement to this.
Defects: your statutory warranty rights remain unaffected. If a delivery is faulty, incomplete or damaged, please contact us immediately by phone or by e-mail at info@pizzalamammawds.de – we will deliver the missing items, replace the dish or refund the price.
Non-perishable goods: for drinks in unopened original packaging that do not spoil quickly, the statutory right of withdrawal of 14 days from receipt of the goods applies. Withdrawal must be declared by e-mail, letter or phone to the contact details given in the legal notice; the model withdrawal form below may be used. Returns are accepted at our shop (Siemensstraße 3/1, 71263 Weil der Stadt) or by post at your expense.
